Privacy Policy

GENERAL RENTAL CONDITIONS

This contract represents a summary of the main provisions of the General Rental Conditions which, together with the rental letter signed by the Customer, constitute the exclusive source that regulates the contractual relationship between Passioni Motori di Arcidiacono Francesco (or its affiliates) and the Customer.

1. ASSIGNMENT OF THE VEHICLE

Driving the rented vehicle is permitted only to a person in possession of a valid type “B” driving license.

Minimum age requirements:

  • 18 years: Only for new drivers, vehicles up to 55 KW
  • After 1 year of holding a “B” license: All types of vehicles up to 9 seats
  • 18 years: For trucks up to 35q

The vehicle is entrusted to the Customer on the assumption that they will use and drive it personally.

The Customer assumes all risks and responsibilities if the vehicle is entrusted to third parties, including liability under Article 116, paragraph 12 of the Highway Code (Legislative Decree 285/92), relating to entrusting a vehicle to someone without a valid license or not authorized by the rental company.

The Customer may communicate additional drivers to the rental company. Authorization will be granted upon verification of valid driving licenses.

2. RENTAL PAYMENT

Payment terms:

  • An advance payment is required as a deposit to confirm the booking
  • The remaining balance is paid at check-in

Accepted payment methods:

  • Bank transfer
  • Card
  • Cash

3. INSURANCE AND LIABILITY (TPL – KASCO – THEFT – FIRE)

The rented vehicle is covered by:

  • R.C.A. Insurance
  • Super Casco Full Coverage (SCDW – Super Collision Damage Waiver)

Coverage includes:

  • Accidents
  • Theft
  • Fire
  • Scratches
  • Side mirrors
  • Roof damage
  • Undercarriage damage
  • Interior damage
  • Glass/windows

Important Conditions:

  • In case of total loss due to drunk driving or drug use, the Customer is liable for 100% of the vehicle’s value
  • In case of theft, the Customer must return the vehicle keys

In all cases (accident, theft, fire):

  • A report must be filed with authorities
  • The report must be delivered to the rental company within 12 hours

Damages are not charged if the Customer provides a properly signed accident report (C.D. form) clearly indicating the counterparty’s responsibility.

The Customer must exercise due diligence while driving. The rental company reserves the right to charge damages caused by Customer negligence.

4. REFUELLING POLICY

The vehicle must be returned with the same fuel level as at delivery.

5. MILEAGE

Unlimited kilometers.

6. VEHICLE USE AND CIRCULATION

The vehicle may only be driven within Italy and in countries listed on the Green Card.

Unauthorized or illegal use:

  • Makes the Customer liable for all damages
  • Removes any limitation of liability
  • Allows the rental company to repossess the vehicle at any time

The Customer is responsible for:

  • Proper use of the vehicle
  • Routine maintenance

No refunds will be provided for damages caused by misconduct or gross negligence.

Examples of Negligence:

  1. Driving on unsuitable roads (fields, rough terrain) causing damage
  2. Violating traffic laws (e.g., red lights, stop signs)
  3. Misuse of navigation systems (e.g., Google Maps leading to damage)

Additional Terms:

  • Roadside assistance must be requested through the rental company
  • The company is not liable for breakdowns, delays, or damages to transported goods
  • Insurance does not cover punctures or tire damage
  • Replacement vehicles are only provided in case of major mechanical/electrical failure
  • No replacement for flat or damaged tires

The Customer is responsible for:

  • Fines
  • Traffic violations
  • Tolls and parking fees
  • Administrative and legal costs

The rental company is not responsible for items left in the vehicle.

Drop-off service is not permitted unless explicitly authorized.

7. RETURN OF THE VEHICLE

The Customer must agree on a return date at the start of the rental.

Key terms:

  • A rental day = 24 hours + 59 minutes tolerance
  • Exceeding this results in an additional daily charge

For fixed-rate rentals (weekend, weekly, etc.):

  • Exceeding time limits results in standard daily rates

Additional conditions:

  • Vehicle must be returned during business hours or agreed time
  • Failure to return keys extends the rental period
  • The vehicle must be returned in original condition (except normal wear and tear)

8. APPLICABLE LAW AND JURISDICTION

This agreement is governed by Italian law.

All disputes fall under the jurisdiction of the court where Passioni Motori di Arcidiacono Francesco is legally registered.

9. PRIVACY POLICY

In accordance with GDPR (Regulation 2016/679), personal data is processed based on principles of:

  • Lawfulness
  • Transparency
  • Data protection

Data Controller:

Data Collected:

  • Personal identification data
  • Identity documents
  • Contact details
  • Bank details
  • Location data (GPS, GSM)

Purpose of Processing:

  • Contract execution
  • Service improvement
  • Complaint management

Failure to provide required data prevents contract execution.

Processing Methods:

  • Manual and digital systems
  • Secure systems to prevent unauthorized access

Data Recipients:

  • Banks and financial institutions
  • Authorized personnel
  • External service providers (legal, IT, administrative, insurance)

10. DATA RETENTION

Personal data is retained for the duration of the contract (including renewals).

The Customer:

  • Gives consent to data processing
  • Confirms acceptance of all terms

If any clause is invalid, the remaining provisions remain enforceable.
